AmSurg Prevails in Dispute with Physician Group in Minnesota

We represented AmSurg Holdings, Inc. in a dispute with a group of physicians seeking to invalidate a non-compete provision that was a material feature of a highly profitable surgery center partnership located in suburban Minneapolis, Minnesota. Following months of contentious discovery and a week-long hearing, the arbitration panel issued a ruling in May 2020 that dismissed the physicians’ claim for declaratory judgment and found in favor of AmSurg’s counterclaim for breach of contract. The arbitration panel also awarded AmSurg $2 million in damages.
