We obtained summary judgment for a home improvement retailer in an FMLA interference case for our client filed by a former employee who claimed that his mistreatment and later termination were unlawful under the ADA and FMLA. We prevailed on summary judgment after the court agreed with our position that the transfer to a lower paying job, which the employee had claimed as mistreatment, was actually an accommodation that he accepted, given his medical issues.
