Water Rights Litigation and Negotiations

Bass, Berry & Sims successfully filed suit against the U.S. Army Corps of Engineers on behalf of a municipality when the Corps sought a several million dollar payment for use of a reservoir for “water storage.” Firm attorney Jessie Zeigler served as lead attorney on this case. Jessie and the team obtained summary judgment on the key issue in the case, resulting in a resolution of the matter. Our firm continued to represent the municipality in pursuing its water rights and negotiating with the Corps through the development of a new reallocation report that explored additional water storage rights on the reservoir.
