As part of an ongoing series, Bass, Berry & Sims attorneys Danielle Sloane and Morgan Tandy authored an article for G2 Intelligence highlighting four recent enforcement actions and cases involving labs and addiction treatment facilities. These actions include alleged violations under the False Claims Act (FCA) and the Eliminating Kickbacks in Recovery Act (EKRA) and demonstrate the Department of Justice’s continued focus on healthcare fraud violations within the lab space.

Danielle and Morgan also discussed the lawsuit filed by the American Clinical Laboratory Association (ACLA) challenging the Food and Drug Administration’s final rule seeking to add regulations to laboratory-developed tests. If the final rule is upheld, it will have significant impact for the lab industry.
