Adam Briscoe represents businesses across a broad range of industries as they navigate the contracting process with federal, state, and local governments. He regularly represents clients in bid protests, disputes, transactions, and compliance matters involving the federal government.
Specifically, Adam’s practice encompasses:
- Bid Protests – Litigating bid protests before the Government Accountability Office (GAO) and the U.S. Court of Federal Claims (COFC).
- Size & Status Protests – Litigating size and status protests before the Small Business Administration (SBA), including appeals to SBA’s Office of Hearings and Appeals (OHA).
- Requests for Equitable Adjustment & Claims – Assisting clients prepare requests for equitable adjustment (REAs) and certified claims under the Contract Disputes Act, and working to resolve them with government customers. When such disputes cannot be resolved through negotiation, representing contractors in litigation against the federal government before the boards of contract appeals (ASBCA and CBCA) and federal courts.
- Mergers & Acquisitions – Conducting due diligence for mergers and acquisitions of government contractors, including identifying red flag issues and supporting the preparation of required filings with federal agencies.
- Transactional – Drafting and negotiating subcontracts, joint venture agreements, mentor-protégé agreements, teaming agreements, and licensing agreements.
- Federal & State Grant Compliance – Counseling federal grant recipients, including businesses and nonprofit organizations, on compliance with the Uniform Guidance (2 CFR Part 200) and agency-specific award terms.
- Non-FAR Based Agreements – Advising companies on Other Transaction Agreements (OTA) and Commercial Solutions Openings (CSOs).
- Regulatory Counseling – Advising companies on a range of compliance matters including SBA regulations and the mentor-protégé program, Build America, Buy America Act (BABA), data rights and intellectual property, and cybersecurity including NIST SP 800-171 requirements and the Cybersecurity Maturity Model Certification (CMMC) program.
Before joining Bass, Berry & Sims, Adam was an associate in the government contracts practice at Wiley Rein LLP. He earned a law degree and M.B.A. from American University and a B.A. in international relations from Reichman University.
